1. Introduction & Acceptance

Welcome to Recovery AI, Inc. These Terms & Conditions ("Terms") govern your use of Ebby™, an AI-powered recovery companion provided by Recovery AI, Inc. ("Company," "we," "us," or "our"), including the Ebby mobile application, related websites, and any SMS or email communications we send (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. The Services

• Ebby is a recovery support companion. It offers conversational support by text and voice, guided exercises and interventions, journaling, daily check-ins, and personalized insights designed to support people in recovery from substance use disorder.

• Ebby is a support tool, not a medical device and not a replacement for professional care. The Services do not provide medical, psychological, diagnostic, or crisis intervention services, and no content within the Services constitutes medical advice.

• If you are experiencing a medical or mental health emergency, or thoughts of harming yourself or others, call 911, or call or text 988 (Suicide & Crisis Lifeline) in the United States. Do not rely on the Services in an emergency.

3. Eligibility & Accounts

• You must be 18 years or older to use the Services.

• You agree to provide accurate account information and to keep your login credentials private. You are responsible for activity that occurs under your account.

• You may stop using the Services and request deletion of your account and data at any time, as described in our Privacy Policy.

4. SMS Messaging & User Consent

• If you opt in to SMS, you consent to receive text messages from Recovery AI, Inc., which may include check-ins, reminders, and support messages. Message frequency varies; message and data rates may apply.

• You can opt out at any time by replying STOP to any message, or reply HELP for help. Opting out of SMS does not affect your use of the app.

5. Acceptable Use

You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to the Services, other users' data, or our systems; (c) interfere with or disrupt the Services; (d) reverse engineer, scrape, or copy the Services or their content except as permitted by law; (e) use the Services to develop a competing product; or (f) misrepresent your identity or impersonate another person.

6. Privacy & Data Protection

• Your information is collected, stored, and used in accordance with our Privacy Policy.

• We implement administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, and we are working toward HIPAA readiness ahead of clinical partnerships.

• No system is perfectly secure. We are not liable for unauthorized access resulting from your failure to safeguard your credentials or device.

7. Early Access

Portions of the Services are currently offered in early access and testing programs. Early access features may change, contain errors, or be discontinued. We may update, modify, or remove features of the Services at any time.

8. Intellectual Property

The Services, including all software, content, designs, and trademarks (including Ebby™), are owned by Recovery AI, Inc. or its licensors. We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own recovery support. You retain ownership of the content you submit (such as journal entries), and you grant us the limited license needed to operate the Services for you, as described in our Privacy Policy.

9. Feedback

If you provide feedback, suggestions, or ideas about the Services, we may use them without restriction or obligation to you.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI-generated responses will be accurate, complete, or appropriate for your circumstances.

11. Limitation of Liability

• Recovery AI, Inc. and Ebby™ do not provide medical advice, and we are not liable for outcomes resulting from your use of, or reliance on, AI-based suggestions, interventions, or other content in the Services.

• To the maximum extent permitted by law, Recovery AI, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of these Terms or the Services will not exceed the greater of one hundred dollars ($100) or the amounts you paid us for the Services in the twelve months before the claim arose.

• Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services, and we will handle your data following termination as described in our Privacy Policy. Sections 8–14 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you through the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.
